1. Scope and contracting party
These terms govern the use of smekkar, a digital service for vegan cooking and nutrition, offered as a mobile app and in the browser. The contracting party is {{entity_name}} {{entity_form}}, {{street}}, {{postal_code}} {{city}}, {{country}}.
2. Account
An account is required. Account details must be accurate and credentials must be kept confidential. An account is personal and is not shared. Use requires a minimum age of 16.
Open question for legal counsel:
Whether 16- and 17-year-olds need the consent of their legal guardians to take out a paid subscription, and whether checkout must capture that consent, has deliberately not been decided here.
3. The service
smekkar provides recipes, a weekly plan, a shopping list, a logbook with nutrition values, and social features (friendships, cooking circles, guests, messages). Compendium content and nutrition values are information, not medical advice. For health questions your doctor decides, not this application.
4. Price, trial and payment
- The price is EUR 5.99 per month. As a small business under § 19 UStG (German VAT Act) no VAT is charged and none is shown. The price stated is the final price. (This statement is still pending tax confirmation.)
- New accounts start with a 14-day free trial with no payment details. If no subscription is taken out during that time, nothing is charged.
- Subscriptions are taken out in the browser; payment and payment-method management run through the payment provider Stripe.
- The subscription renews monthly until it is cancelled.
- Invoices are delivered by e-mail.
5. Cancellation
You may cancel at any time. Cancellation takes effect at the end of the period already paid for; until then the full functionality remains. There is no pro-rata refund unless mandatory law provides otherwise.
6. Failed payment
If a payment fails, full access remains for seven days (the grace period). If the payment goes through in that time, nothing changes. Otherwise the account moves to read-only mode.
7. Read-only mode
If the subscription ends, the account is not deleted. Read-only mode keeps:
- reading your own recipes, plans, lists and logbook,
- exporting all of your data,
- deleting the account,
- access to support,
- resubscribing at any time.
What is unavailable is writing: creating, editing and ticking things off.
8. Your content
Your content stays yours. So that the service can work, you grant us the simple, revocable right to store and process your content and to display it to those you share it with — that is, to yourself, to your friends, to your cooking circle and to the guests you invite. No further right of use is granted; your content is not used for advertising and is not sold.
9. Rules
Prohibited in particular are unlawful content, harassment, hate speech, misrepresenting who you are to other members, automated bulk use, and attempts to circumvent the security of the service. Reported content is reviewed; the possible measures are notices, removal of content, temporary restrictions on social features, and suspension of the account. Measures are given a reason.
10. Availability
We aim for availability of at least 99.5 % on a monthly average. Maintenance, malfunctions and events outside our control can cause interruptions; availability is not guaranteed.
11. Liability
Open question for legal counsel:
The liability provision has deliberately not been drafted here. A liability clause is exactly the place where self-written text can be void without anybody noticing. Please insert it during the review.
12. Changes to these terms
The current version and its effective date are at the end of this page; we will inform you about a new version.

How should a new version of these terms or of the privacy policy bind existing members? The draft deliberately says nothing about it. An earlier wording provided that without acceptance of the new version the previous one continues to apply until the contract ends — the product currently has no acceptance or objection flow. Please settle this during the review.
13. Governing law
German law applies. If you are acting as a consumer, the mandatory consumer protection provisions of your country of residence remain unaffected and the statutory places of jurisdiction apply.
